Boston– Boston law firm Davis Malm announced that Paul Feldman and Shawn McCormack represented developer 263-269 Pleasant Street LLC in a permitting litigation matter in connection with the client’s plan to develop the first assisted living facility in Marblehead, MA.

After the Marblehead Zoning Board initially denied permits, Mr. Feldman and Mr. McCormack represented the client in an appeal to the Land Court. They successfully had the matter remanded to the Zoning Board for further consideration, resulting in permits being issued.

Abutters opposing the project then filed appeals in the Lawrence Superior Court, which, after a six-day bench trial, upheld the issuance of the permits. Abutters further appealed, and the Appeal’s Court affirmed the Superior Court decision.

The $35 million project, to be built on approximately 4.5 acres located on Pleasant Street, includes developing an 87-unit assisted living and memory care housing facility called The Mariner that Northbridge Companies will manage.
